Article 1 (Application)

These Terms of Service ("Terms") set forth the conditions for using the SEO check service "CodeQuest.work SEO_CHECK" ("the Service") provided by ORECTIC / CodeQuest.work ("the Company"). By using the Service, you agree to be bound by these Terms.

Article 2 (Definitions)

The following terms used in these Terms are defined as follows:

"User" refers to all individuals and entities that use the Service
"Registered User" refers to a User who has completed account registration
"Paid Plan" refers to the Entry, Basic, and Pro plans
"Content" refers to SEO check results, improvement code, reports, and other materials provided by the Service

Article 3 (Registration)

Registration is completed when an applicant applies for registration through the method prescribed by the Service and the Company approves such application. The Company may refuse registration in the following cases:

If the registration information contains false information
If the applicant has previously violated these Terms
If the Company otherwise determines that registration is inappropriate

Article 4 (Account Management)

Users shall manage their email address and password for the Service at their own responsibility. The Company assumes no liability for any damage caused by inadequate management or use by third parties. Users may not transfer or lend their account to third parties.

Article 5 (Pricing Plans and Payment)

The Service offers a free plan and paid plans (Entry, Basic, Pro). Fees for paid plans are as displayed on the pricing page and shall be paid monthly via credit card through Stripe.

Subscriptions are billed monthly and cancellation is available at any time
Plan changes take effect immediately; proration follows Stripe's system
The free plan has usage limits

Article 6 (Refund Policy)

Due to the nature of monthly subscriptions, refunds are generally not provided. However, if the Service is unavailable for an extended period due to a significant issue on our end, we will handle it on a case-by-case basis. Please contact info@orecticdesign.com for inquiries.

Article 7 (Intellectual Property)

Intellectual property rights related to the Service's UI, design, software, and logos belong to the Company. SEO check results and improvement code suggestions generated by the Service may be freely used by Users, but the Company does not guarantee their accuracy.

Article 8 (Prohibited Activities)

Users shall not engage in any of the following activities when using the Service:

Actions that violate laws or public order and morals
Actions that place excessive load on the Service's servers or network
Automated mass access through scraping, crawling, or similar means
Actions that may interfere with the operation of the Service
Collecting or accumulating personal information of other users
Unauthorized access or attempts thereof
Unauthorized use of the Service's API
Unauthorized reproduction or redistribution of the Service's content
Using the Service for the purpose of developing a competing service

Article 9 (Account Suspension and Deletion)

The Company may suspend or delete a User's account without prior notice if the User violates these Terms or falls under any of the following:

If prohibited activities are confirmed
If registration information is found to be false
If the User does not respond to communications from the Company for a certain period
If the Company otherwise determines that use of the Service is inappropriate

Article 10 (Service Suspension)

The Company may suspend or interrupt all or part of the Service without prior notice in the following cases:

When performing maintenance, inspection, or updates to the computer systems
When provision becomes difficult due to force majeure such as earthquakes, lightning, fire, or power outages
When external services (Cloudflare, Stripe, etc.) experience outages
When the Company determines that provision is otherwise difficult

Article 11 (Service Modification and Termination)

The Company may modify or terminate the Service with prior notice to Users. In the event of service termination, notice will be given at least 30 days in advance through the Service or via email.

Article 12 (Disclaimer)

SEO check results, scores, improvement suggestions, and other content provided by the Service are for informational purposes only. The Company makes no guarantees regarding:

Improvement in search engine rankings
Complete accuracy of SEO check results
Accuracy of data obtained from third-party APIs (domain power, search volume, etc.)
Uninterrupted or error-free service availability

Article 13 (Limitation of Liability)

Even if the Company is liable to a User, such liability shall be limited to direct and actual damages, up to the total amount of fees paid by the User to the Service in the preceding 12 months.

Article 14 (Withdrawal)

Users may delete their account and withdraw from the Service at any time from the settings page. If the User is subscribed to a paid plan at the time of withdrawal, the subscription will be automatically canceled. After withdrawal, all account data and check history will be permanently deleted and cannot be recovered.

Article 15 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Saitama District Court as the court of first instance.

Article 16 (Changes to Terms)

The Company may modify these Terms when deemed necessary. In the event of significant changes, notice will be given through the Service or via email. Modified Terms shall take effect from the time they are posted on the Service.
